I made a tactical mistake today.
I played an aggressive hand based on a mistake of law. Shit. I thought I could play a card I don't have.
It only meant that we failed to settle, and rhe nuclear option I had in mind to subvert the thing won’t work. The client is no worse off than he was yesterday - he has a lawsuit without a settlement. But they will be pissed that the plan has no hope of success, and we are going to have to negotiate on terms we don’t like.
But I hate being wrong, and I hate making mistakes. I am usually good at solving problems, but everything I have tried in this scenario has failed. It doesn't happen to me often, but here it is. It hurts. I want to help this guy, and I want to have an answer. There just might not be one.

Were all human mate, it’s learning from mistakes that count. Your aware what happened and know for next time. In the meantime you’ve just got to make the best of it and you may just catch them making an error to capitalise on and level the playing field a little more.

You made a mistake. If it’s not fatal, n ow comes the real test: how will your feelings about making that mistake affect you? Will they give you new resolve? Or derail you?

You can buy the mug on Amazon for $22. IMO buying a porcelain mug for $22 is another mistake though.

Counselor, from one lawyer to another (NY Bar#3980661), you are tilting on a field that is seldom flat and level. Argued once in front of a judge who was almost thrown off the bench, but he got brain cancer, so they felt sorry for him and let him stay. My argument was spot on - the other side was lying about the case law. But that judge, that day, failed to use that one part of his body that I needed him to, and case dismissed. Did not have money to mount an appeal (class action). You will stand up the next time and fight.
